Eligibility and Registration

Age Requirements

You must be at least 18 years old to use our services. If you are under 18, you may only use our services with parental or guardian consent and supervision.

Account Registration

For certain services, you may need to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as necessary
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorised use

Service Agreement

Booking and Enrolment

When you book our services:

  • A contract is formed when we confirm your booking
  • You agree to attend all scheduled sessions
  • You commit to active participation in training activities
  • You acknowledge that results depend on your engagement and practice

Service Delivery

We will provide services in accordance with:

  • The specific program description you enrolled in
  • Professional industry standards
  • Australian Consumer Law requirements
  • Any additional terms agreed upon in writing

Your Responsibilities

As a participant, you agree to:

  • Attend sessions punctually and prepared
  • Complete assigned exercises and practice activities
  • Treat instructors and other participants with respect
  • Maintain confidentiality of other participants' information
  • Follow safety guidelines and venue rules

Payment Terms

Pricing and Fees

All prices are:

  • Listed in Australian Dollars (AUD)
  • Inclusive of GST where applicable
  • Subject to change with 30 days' notice
  • Final once confirmed in your booking

Payment Methods

We accept payment via:

  • Credit cards (Visa, Mastercard, American Express)
  • Bank transfer
  • Payment plans (for qualifying purchases)
  • Corporate invoicing (approved accounts only)

Payment Schedule

  • Individual Sessions: Payment due upon booking
  • Multi-session Programs: 50% deposit required, balance due before program commencement
  • Corporate Training: Payment terms as agreed in contract

Late Payments

Late payments may result in:

  • Suspension of services until payment is received
  • Interest charges of 1.5% per month on overdue amounts
  • Recovery costs if collection action is required

Cancellation and Refund Policy

Client Cancellations

Individual Sessions:

  • More than 48 hours: Full refund
  • 24-48 hours: 50% refund
  • Less than 24 hours: No refund

Multi-session Programs:

  • Before program starts: 90% refund (10% administration fee)
  • Within first week: 50% refund of remaining sessions
  • After first week: No refund for remaining sessions

Pomod Super Cancellations

If we need to cancel or reschedule:

  • We will provide at least 24 hours' notice when possible
  • You will receive a full refund or free rescheduling
  • We are not liable for consequential damages

Force Majeure

Neither party is liable for delays or cancellations due to circumstances beyond reasonable control, including natural disasters, government actions, or public health emergencies.

Intellectual Property

Our Content

All content provided by Pomod Super, including but not limited to:

  • Training materials and methodologies
  • Presentations and handouts
  • Audio and video recordings
  • Website content and design
  • Trademarks and logos

Remains our exclusive property and is protected by copyright and other intellectual property laws.

Your Usage Rights

You may:

  • Use materials for personal learning and development
  • Apply techniques learned in your professional activities
  • Share general concepts (not specific materials) with colleagues

You may not:

  • Reproduce or distribute our materials without written permission
  • Use our content for commercial training purposes
  • Reverse engineer our methodologies
  • Remove copyright or other proprietary notices

Confidentiality

Mutual Confidentiality

Both parties agree to maintain confidentiality of:

  • Personal information shared during training
  • Business information and strategies discussed
  • Other participants' information and progress
  • Proprietary training methods and materials

Recording Policy

Audio or video recording of sessions is prohibited without explicit written consent from all parties involved.

Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability is limited to the amount you paid for the relevant service
  • We are not liable for indirect, consequential, or special damages
  • We do not guarantee specific outcomes or results
  • You acknowledge that skill development requires time and practice

Consumer Guarantees

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees under Australian Consumer Law that cannot be lawfully excluded.

Prohibited Conduct

You agree not to:

  • Disrupt training sessions or other participants
  • Use our services for illegal or harmful purposes
  • Infringe on others' intellectual property rights
  • Share false or misleading information
  • Attempt to damage our reputation or business
  • Violate any applicable laws or regulations

Consequences

Violation of these terms may result in:

  • Immediate termination of services without refund
  • Legal action for damages
  • Reporting to relevant authorities

Acceptable Use

When using our website, you agree to:

  • Use it only for lawful purposes
  • Not attempt to gain unauthorised access
  • Not introduce viruses or malicious code
  • Respect our bandwidth and server resources
